Alexander Holburn Successful in OW Bunker Litigation
Associate Counsel, David McEwen, Q.C., and Partner, Jason Lattanzio, were successful in defending Canpotex Shipping Services Ltd., a Canadian company and the world’s largest potash exporter, from “double jeopardy” in relation to unpaid marine bunkers. The litigation stems from the bankruptcy of OW Bunker, one of the world’s largest traders of bunker fuel. The Canadian case forms part of the world-wide litigation surrounding the bankruptcy, as both OW’s receivers and the unpaid bunker suppliers seek to recoup their losses. Currently, similar matters are being litigated in various jurisdictions around the world including the United Kingdom, the United States, Greece, Singapore, India, and Brazil.
