PRACTICE PROFILE

Emily is a member of the firm’s Wealth Preservation & Estate Litigation and Commercial Litigation Practice groups. Prior to joining Alexander Holburn, Emily clerked at the British Columbia Supreme Court. She summered and articled at Alexander Holburn, joining as an associate in July 2009.

REPRESENTATIVE EXPERIENCE

Emily has assisted clients in all levels of court in British Columbia in commercial and estate litigation matters. She has assisted senior counsel with trials before the British Columbia Supreme Court and prepared materials for the British Columbia Court of Appeal. She has appeared in Supreme Court Chambers and British Columbia Provincial Court on a variety of matters. She has assisted clients in negotiating and mediating settlements to disputed claims. She had provided advice to individuals, charities, financial institutions and municipalities.

Estate Matters:

  • General estate planning advice regarding wills, power of attorney instruments, representation agreements and trusts;
  • Estate administration, including probate, administration and passing of accounts;
  • Dealt with litigation cases involving the Wills Variation Act, testamentary capacity, undue influence, allegations of breaches of duties by trustees, trust variation applications, charitable trusts and committeeship applications.

Representative experience includes:

  • Wilson v. Lougheed, 2010 BCSC 1868
  • Wilson v. Lougheed, 2009 BCSC 1841

Commercial Litigation Matters:

  • Contract disputes
  • Oppression remedy petitions
