PRACTICE PROFILE

Stuart Lang is a senior partner of Alexander Holburn Beaudin & Lang LLP.  Stuart is Chair of the firm’s Health Practice and a senior member of the Corporate/Commercial Practice.

Stuart practices health and corporate law, focusing on health care issues for health authorities, public and private hospitals and other public and private sector clients.  He is involved in negotiating a wide spectrum of health care transactions, public private partnerships, development of medical research infrastructure, acquisition of medical equipment and software programs, partnerships between health authorities, software license agreements, creation of patent and intellectual property policies, clinical research and research collaboration agreements, clinical trial contracts, construction of hospital and research facilities, outsourcing, requests for proposals, tendering documentation, advising on amalgamations, alliances and affiliations with hospitals, health authorities, universities, research institutes and foundations, and health authority governance.

Stuart is recognized for his broad health care expertise and has provided guidance and advice to BC Children’s Hospital for over 35 years.  He provides counsel to the Provincial Health Services Authority and its agencies which include BC Cancer Agency, BC Centre for Disease Control, BC Children’s Hospital, BC Women’s Hospital, Sunny Hill Hospital, Riverview Hospital, PHSA Cardiac Services, the Provincial Renal Agency and the BC Transplant Society.  Stuart also assists other regional health authorities as well as organizations supporting health care research and the creation of additional research infrastructure capacity within the province such as the Child and Family Research Institute, Women’s Health Research Institute, British Columbia’s Children’s Hospital Foundation and the Michael Smith Foundation.

As a senior member of the Corporate/Commercial Practice Stuart has also acted for Canadian and International corporations with respect to the acquisition or divestiture of a wide variety of commercial enterprises and has a wide range of experience with corporate management, acquisitions, reorganizations and mergers.

Stuart articled to Mr. Earnest A. Alexander, Q.C. and has practiced with Alexander Holburn Beaudin & Lang LLP since his call to the Bar.

REPRESENTATIVE EXPERIENCE

  • Acted as hospital counsel in amalgamating BC Children’s Hospital, Sunny Hill Health Centre for Children and BC’s Women’s Hospital & Health Centre
  • Acted as health authority counsel in the establishment of the BC Telehealth Project Agreement for the implementation of telehealth services throughout British Columbia
  • Acted as counsel in the preparation of requests for proposals and outsourcing agreements for health authorities and the resulting contracts to outsource non-clinical services to the private sector
  • Acted as health authority counsel with respect to the public-private partnership for the design build, financing and operation of the Abbotsford Hospital
  • Initiated and assisted in effecting a significant amendment to the Health Authorities Act to ensure bequests did not fail by reason of the amalgamation and dissolution of various hospital societies
  • Acted as hospital counsel in the negotiation of the lease and funding agreements to facilitate the construction of the new $95 Million BC Cancer Research Centre, one of Canada’s largest cancer research facilities
  • Acted as counsel in establishing the BC Research Institute for Children’s & Women’s Health and the Michael Smith Foundation
  • Acted as hospital counsel in preparing clinical research agreements and collaborative research agreements with Merck Frosst and other pharmaceutical corporations funding medical research
  • Acted as hospital counsel in the establishment of patent and licensing policies, technology agreements, and research affiliation agreements between hospitals and universities
  • Acted as corporate counsel in negotiations with First Nations and the Province in respect of the development of a major interior resort facility
  • Acted as Canadian counsel in the acquisition of a $100 Million agri-food business
