PRACTICE PROFILE


Krista Prockiw is a member of the firm’s Insurance Practice Group. Her practice includes a wide variety of insurance defence matters, including personal injury, product liability and professional indemnity claims. She also regularly provides coverage opinions and handles subrogated matters for insurers.

REPRESENTATIVE CASES

  • Has acted as counsel on numerous occasions in both the trial and appellate courts of B.C.
  • Resolved numerous personal injury cases including those involving catastrophic injuries such as brain injuries and quadriplegia.
  • Provided insurance coverage analysis under commercial general liability, homeowners, builders’ risk and automotive insurance policies and defended claims for coverage brought against insurers.
  • Acted as counsel for insurers in overlapping and concurrent coverage situations.
  • Acted as counsel to insurers in coverage denials involving allegations of bad faith and policy interpretation.
  • Successfully upheld a denial of coverage in the first British Columbia case considering the scope of coverage for water “escape” under a homeowner’s policy: Graham v. Canadian Direct Insurance Inc. 2007 BCSC 1291.
  • Defended a forestry contractor in a claim for recovery of fire suppression costs and damaged forest resources under the Wildfire Act and Regulations.

RECENT PUBLICATIONS AND CONFERENCES

  • Acts as associate editor of the Canadian Journal of Insurance Law, a national bi-monthly publication for insurance professionals and legal practitioners.
  • Guest speaker at the 2010 Insurance Brokers of British Columbia’s Habitational Symposium on the Top Habitational Issues Today.
  • Regularly presents seminars for the Insurance Brokers Association of British Columbia. Topics presented in 2010 and 2011 include strata insurance issues, commercial liability endorsements, coverage analysis, bad faith issues, broker’s duty and standard of care, upcoming changes to the Insurance Act, Directors and Officers insurance and coverage and claims under Homeowners’ Policies.
  • Guest speaker at the 2010 Canadian Defence Lawyers’ L.A. Law Conference on the upcoming changes to the Insurance Act and its impact on litigation support staff.
  • Guest speaker at the 2010 Credit Union Insurance Services Association’s Annual Conference on amendments to British Columbia’s Insurance Act.
  • In addition to the above seminars and speaking engagements in 2010-2011, Krista has previously presented to the British Columbia Society of Fellows, the Claims Managers Association, the Insurance Institute of British Columbia, and at Insight’s Disability Claims Management and Litigation conference as well as at numerous in-house seminars for Insurers, Brokers and Adjusting Firms.
